Metricstory Incorporated dba Ampd (“Ampd,” “we” or “us”) develops and operates a cloud-based ad management and analysis platform ("Platform") and also provides certain managed services (“Managed Services,” and collectively with the Platform and any of our other services via any websites, applications, mobile applications, software or other properties operated by Ampd, our “Services”). Our Services make it easy for customers of Ampd, such as you (“you” or “Subscriber”), to manage and optimize their digital ad campaigns across multiple ad networks, including but not limited to those managed by Amazon, Google and Facebook. Our Services are more fully described in our Terms of Service, which can be found here: https://www.ampd.io/terms-of-use. We also operate websites, including without limitation at www.ampd.io, ampd.io, app.ampd.io, and any successor URLs, mobile or localized versions, and related domains and subdomains (collectively, our “Sites”). Our Services and our Sites are collectively referred to herein as our “Offerings.”

At Ampd, we respect the privacy rights and data protection rights of our users and recognize the importance of protecting the personal information we collect about you. This document, the Ampd Privacy Policy (our “Privacy Policy”), is designed to help you understand what information we collect about you and how we use and share that information when you use our Offerings.

Our Privacy Policy is a legally binding contract between you and Ampd, so please read it carefully. If you do not agree with our Privacy Policy, please do not register for or use our Offerings. By using our Offerings or by registering for an Ampd account, you are agreeing to be bound by our Privacy Policy. If you are accessing or using our Offerings on behalf of an organization, you are agreeing to our Privacy Policy for that organization and warranting to Ampd that you have the authority to bind that organization to our Privacy Policy.

Information We Collect

Information You Provide to Us

 

Registration, Contact, and Preference Information. When you (a) request, through our Sites, a demonstration or quote of our Services, (b) log in to use our Services, and (c) otherwise provide contact information to us directly, through email, phone, or otherwise, we collect the information that you provide, which include your first and last name, email address, phone number, company name, and your company’s annual advertising spend. You may also provide us with contact information of other employees or representatives of your organization who are also using our Services. Certain information may be required from you in order for you to register with us or to take advantage of some of the features of our Offerings. When you set your preferences within our Offerings, we also collect information about your preferences. We do not collect contact or personal information of your customers through your use of our Services.

Payment Information. When you subscribe to or otherwise purchase our Services, our third-party service providers will collect transaction information, which may include your credit card information, billing and mailing address, and other payment-related information (“Payment Information”). We describe how Payment Information may be collected and processed in the section titled “Payment Information” below. Although our third-party service providers will collect Payment Information, Ampd does not directly collect or access Payment Information.

Third-Party Account Information. If you use our Services and authorize us to access and use your data from a third-party site or service (for example, Amazon Services LLC and/or its affiliates), or if you sign into our Services through a third-party site or service, content, and information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy. No contact or personal information of your customers will be transmitted into your account with us, or otherwise to our Services, as part of such Third Party Account Information.

 

Information Collected Automatically

 

Technical, Usage, and Location Information. When you visit our Sites, we automatically collect information on how you interact with our Sites, such as the IP address from which you access our Sites, date and time, information about your browser, operating system and computer or device, pages or features viewed and items clicked or tapped. We may also collect location information when you use our Sites, including location information automatically provided by your computer or device. We use cookies and similar technologies on our Sites to collect some of this information. We do not collect any of the information described in this section when you use our Services, only when you visit our Sites.

Third-Party Platforms. We may collect information when you interact with our advertisements and other content on third-party sites or platforms, such as social networking sites. This may include information such as “Likes,” profile information gathered from social networking sites, or the fact that you viewed or interacted with our content.

Other Information. We may collect other information from you that is not specifically listed here. We will only use any such information in accordance with our Privacy Policy or as otherwise permitted by you.

 

Legal Basis

 

Performance of Contracts. We process and store information you provide to us in order to perform our contracts with you for our Offerings and communicate with you regarding our Offerings. Without this information, we would not be able to provide our Offerings to you.

Legitimate Interests. We also process information you provide to us to pursue our legitimate interests. Ampd products help anyone who sells online save time and drive better growth through advertising. In order to engage visitors and leads, we have a legitimate interest to collect relevant data and send messages based on this information. We consider your privacy rights and data protection rights when we pursue our legitimate interests and ensure that the way our Offerings work does not impact those rights.

Consent. Where you have opted in to receive marketing communications from us, we will process your personal information to provide you with marketing communications in line with the preferences you have provided. You are not under any obligation to provide us with your personal information for marketing purposes, and you can withdraw your consent to your personal information being processed in this way at any time by emailing info@ampd.io or, where relevant, by following the unsubscribe link in any marketing communication you receive from us. If you do choose to withdraw your consent, this will not mean that our processing of your personal information before you withdrew your consent was unlawful.

How We Use the Information We Collect

 

We use your information in the following ways:

  • To provide, maintain, and improve our Offerings and our other products and services, including to operate certain features and functionality of our Offerings (for example, by remembering your information from your visits to our Sites so that you will not have to re-enter it during your then-current visit or subsequent visits to our Sites);
  • To process your inquiries or otherwise deliver customer service on our Offerings;
  • To process your payments, our third-party service providers use Payment Information as described in the section titled “Payment Information”;
  • To control unauthorized use or abuse of our Offerings and our other products and services, and to detect, investigate, or prevent activities that may violate our policies or be illegal;
  • To analyze trends, administer or optimize our Offerings, and monitor usage or traffic patterns (including to track users’ movements around our Sites);
  • To communicate directly with you, including by sending you newsletters, promotions and special offers or information about new products and services (your opt-out options for promotional communications are described in the section titled “Your Controls and Choices”);
  • To deliver you advertising, including by serving and managing ads on our Sites or on third-party sites, and to tailor ads based on your interests and browsing history (please see the section titled “Your Controls and Choices” for additional information on how to manage the ads you see); and
  • In the manner described to you at the time of collection or as otherwise described in our Privacy Policy.

 

Sharing Your Information with Third Parties

 

We neither rent nor sell personal information in a personally identifiable form to anyone. However, we may share with third parties personal information obtained from your visits to our Sites or from our marketing activities or events or engage third parties to collect personal information on our behalf, as described in this section:

Analytics: We use 3rd party analytics such as HubSpot, Google Analytics, and Hotjar (collectively “Analytics”) to help analyze how our customers use our Sites when they visit our Sites. Our Analytics use cookies to collect information such as how often customers visit our Sites, what pages they visit, and what other sites they used prior to coming to our Sites. We use the information we get from Analytics only to improve our Offerings. Analytics collects the IP address assigned to a customer on the date the customer visits our Sites and, in some cases, the customer’s name or other personally identifying information. Although Analytics plants a persistent cookie on a customer’s web browser to identify a unique customer, the next time that customer visits our Sites, the cookie cannot be used by anyone but our Analytics services. Our Analytics providers’ ability to use and share information collected about visits to our Sites is restricted by their internal terms of use and privacy policies.

Agents: We share your personal information obtained from your visits to our Sites or from our marketing activities or events with third-party service providers to permit such parties to provide services that help us with our business activities, which may include assisting us with marketing, advertising our product/service offerings, or providing, maintaining and improving the features and functionality of our Offerings, among other things. For example, we provide personal information obtained from your visits to our Sites or from our marketing activities or events to our marketing service providers for direct emailing of our newsletters or notifications of our product/service offerings. The data shared can include name, job title, email address, message history, and company information. All third parties are engaged under contract and obliged to meet appropriate security requirements and comply with all applicable legislation. We also engage third-party customer management system service providers such as HubSpot to collect and manage customer information from our Sites and our marketing activities and events for us. For example, we use HubSpot’s mobile app to capture customer data and scan business cards at events, take notes and automatically log calls. Unless expressly informed differently, our agents do not have any right to use the personal information we share with them or they collect for us beyond what is necessary to assist us.

Business Transfers: We may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. Also, if we or our assets are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information obtained from your visits to our Sites or from our marketing activities or events could be one of the assets transferred to or acquired by a third party.

Protection of Ampd and Others: We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order, enforce or apply our Terms of Service and other agreements, or protect the rights, property, or safety of Ampd, our employees, our users, or others.

Security: We may share your personal information obtained from your visits to our Sites or from our marketing activities or events with third parties (including our service providers and government entities) to detect, prevent, or otherwise address fraud, security, or technical issues.

Partnerships: We may share your personal information obtained from your visits to our Sites or from our marketing activities or events with our business partners who offer a service to you jointly with us, for example, when running a cross-promotion.

Payments: Our Third-Party Service Providers will use your Payment Information to process your payments, as further described in the section titled "Payment Information".

Consent: We may share your personal information with a third party if we have your consent to do so.

Aggregated and Anonymized: We may also share or use information on an aggregated and anonymized basis with third parties, in which any information that could reasonably identify you or any of your customers will be removed or changed before the information is shared or used to improve our Offerings and our related product and service offerings, to create new Ampd services relating to our Offerings, and to publish aggregated results. Such information may include usage, viewing and technical information such as the types of Offerings our customers and users generally use, the configuration of their computers, and performance metrics related to the use of our Offerings which we collected through our technology. If we are required under applicable law to treat such information as personal information, then we will only disclose it as described above. Otherwise, we may disclose such information for any reason.

Payment Information

 

When you subscribe to or otherwise purchase our Offerings, any credit card information you provide as part of your Payment Information is collected and processed directly by our payment processor, Stripe, through their Stripe Checkout service. We never receive or store your full credit card information. Stripe commits to complying with the Payment Card Industry Data Security Standard (PCI-DSS) and using industry-standard security. Stripe may use your Payment Information in accordance with their own privacy policy, which can be found here: https://stripe.com/us/checkout/legal.

 

Other Access to or Disclosure of Your Information

 

Our Offerings may also contain links to third-party websites. Our Privacy Policy applies solely to information collected by us. Even if the third parties are affiliated with us through a business partnership or otherwise, we are not responsible for the privacy practices of such third parties. We encourage you to familiarize yourself with the privacy policies of such third parties to determine how they handle any information they separately collect from you. Please be aware that we do not warn you when you choose to click through to another website when using our Offerings.

Your Rights and Choices

 

Opt-Outs. When you visit our Sites and provide your personal information, we may provide you with the opportunity to “opt out” of having your personal information used for certain purposes when we ask for this information. You can also opt out of your personal information being processed at any time for marketing communications by emailing info@ampd.io or, where relevant, by following the unsubscribe link in any marketing communication you receive from us. If you decide to opt out, we may not be able to provide certain features of our Offerings to you.

Communication Preferences. If you no longer wish to receive our newsletter and promotional communications, you may opt out of receiving them by following the instructions included on such communications or on our Offerings or by emailing info@ampd.io. Please note, however, that you may be unable to opt out of certain service-related communications regarding our Services.

Blocking Cookies. You can remove or block certain cookies using the settings in your browser, but our Offerings may cease to function properly if you do so.

Data Subject Rights. You can access, rectify, erase, restrict, or export your personal information at any time by emailing info@ampd.io. When updating information, however, we may maintain a copy of the unrevised information in our records. Some information may remain in our records after account deletion of such information from your account. We may use any aggregated data derived from or incorporating personal information after an account has been updated or deleted, but not in a manner that would identify you or any of your customers personally. You can object to our processing of your personal information at any time. If you are unsatisfied with the response, you have the right to lodge a complaint with your supervisory authority.

Your Rights Under Cal. Bus. & Prof. Code Section 22575(b) (“Do Not Track” Browser Settings). You are entitled to know how we respond to “Do Not Track” browser settings. Some internet browsers offer a “do not track” feature. When enabled, your browser sends a signal to the sites you visit, directing the sites not to track your activity. Like many other websites and online services, we do not currently alter our practices on our Sites when we receive Do Not Track signals as there is no consensus among industry participants as to what “Do Not Track” means in this context. If you do not wish to be tracked, disabling or deleting cookies may limit some forms of tracking. Disabling or deleting cookies may affect your user experience on our Sites, including preventing the usage of certain features or functions. As described elsewhere in our Privacy Policy, we and our service providers may track your activity while on our Sites. We may also track the website or application you were on before entering our Sites and the website or application you land on after you leave one of our Sites. Your California Privacy Rights

 

California law entitles California residents to certain additional protections regarding Personal Information. For purposes of this section alone, “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. California residents have the right to request:

●      information regarding your Personal Information we have collected in the past 12 months (including the categories of Personal Information we have collected, the categories of sources of such information, and the purposes for which we have collected such information);

●      notice of whether we have disclosed your Personal Information to third parties in the past 12 months (and if so, what categories of information we have disclosed, and what categories of third parties we have disclosed it to);

●      a copy of your Personal Information collected by us in the past 12 months; and

●      that your Personal Information be deleted.

 

We will not discriminate against you if you choose to exercise any of these rights. To make any of the above requests, please contact us as set forth at the end of our Privacy Policy. We may require verification of your identity before further processing your request. In certain instances, we may be permitted by law to decline some or all of such requests.

 

Accessing and Updating Your Personal Information

 

When you use our Offerings, we make good faith efforts to provide you with access to your personal information upon your request and either provide you the means to correct this information if it is inaccurate or to delete such information at your request if it is not otherwise required to be retained by law or for legitimate business purposes. You may access, review, correct, update, change or delete your information at any time. To do so, please email info@ampd.io with your name and the information requested to be accessed, corrected or removed. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort (for instance, requests concerning information residing on backup tapes), jeopardize the privacy of others, would be extremely impractical, or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

Please note that if you cease using our Offerings or we terminate your access to our Offerings in accordance with our Terms of Service, you may no longer have the ability to access or update your information.

We may retain your information as necessary to support our Offerings, comply with our legal obligations or resolve disputes.

 

Changes to the Privacy Policy

 

We reserve the right to change our Privacy Policy at any time. If we make changes, we will post them and indicate on this page our Privacy Policy’s new effective date. If we make material changes to our Privacy Policy, we will notify you by email or through notice on our Sites.

 

No Children Under Age 16

 

Our Offerings are not intended for use by anyone under the age of 16, nor does Ampd knowingly collect or solicit personal information from anyone under the age of 16. If you are under 16, you may not attempt to register for our Offerings or send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we confirm that we have collected personal information from someone under the age of 16 without verification of parental consent, we will delete that information promptly. If you are a parent or legal guardian of a child under 16 and believe that we might have any information from or about such child, please contact us at the email address provided at the end of our Privacy Policy.

 

Security

 

The security of your personal information is important to us. We maintain a variety of appropriate technical and organizational safeguards to protect your personal information. We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs. Further, we have implemented reasonable physical, electronic, and procedural safeguards designed to protect personal information about you. When you enter sensitive information (such as your password), we encrypt that information in transit using industry-standard Transport Layer Security (TLS) encryption technology. No method of transmission over the Internet, method of electronic storage, or other security methods are one hundred percent secure. Therefore, while we strive to use reasonable efforts to protect your personal information, we cannot guarantee its absolute security.

Your account is also protected by a password for privacy and security. You must prevent unauthorized access to your account and personal information by selecting and protecting passwords and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

 

Users Outside of the United States and Consent to Transfer

 

Our Offerings are operated in the United States. If you are located in another jurisdiction, please be aware that the information you provide to us will be transferred to, stored, and processed in the United States. By using our Offerings or providing us with any information, you consent to this transfer, processing, and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen such as countries in the European Union. You understand that the U.S. government can obtain access to the personal information you submit if necessary for investigative purposes (e.g., terrorism investigation). We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with our Privacy Policy. We use appropriate and suitable safeguards for transferring your personal information to the U.S. (e.g., standard contractual clauses issued by the European Commission).
